LAW6409 Workshop 4: Revision and Formative Questions

Introduction

We have now covered all the substantive material for the module. This workshop is aimed at getting you to reflect on what you have learned so far and to put your knowledge into practice by preparing and getting feedback on a piece of formative work. The work you complete in this session will assist you when it comes to completing the final assessment.

Revision Questions

Consider what actions, if any, may be available under the Equality Act 2010 in each of the following scenarios:

Wing works for Aston Hospital as a secretary. She has been asked on several occasions by a colleague, Bob, to date him. She has refused these invitations but recently Bob threatened to “make her life at work a misery” if she would not go to the cinema with him. Wing complained to her boss who did nothing about it. Wing has since received a nasty letter from Bob, accusing her of “flirtatious and sexually provocative behaviour”.

Clara and Peter both apply to Aston Hospital for a job as a Medical Records Clerk. Clara has had previous experience of this work, and has 4 GCSEs, the advertised requirement for the job. Peter has 3 GCSEs and has worked as a hospital porter before. After the interviews Peter is offered the job.

There is a dispute between the Hospital’s managers and the catering staff who have discovered that the maintenance workers are earning almost twice as much pay per hour. Most of the catering staff are female and part-time workers and most of the maintenance workers are male and working full-time hours. All full-time workers in the hospital receive a Christmas bonus and the caterers have also discovered this fact.

Formative Questions

Prepare an essay plan / outline answer for one of the following questions.

Critically assess the extent to which the Equality Act 2010 ensures that disadvantaged groups can enjoy substantive equality in the workplace.

Critically assess whether the characteristics covered by the Equality Act 2010 are adequate to protect people against discrimination, or if it would be better to move to a broader ‘status based’ approach.

Critically assess the effectiveness of the Equality Act 2010 in addressing the problem of “algorithmic discrimination”.

During the workshop you will be required to work in groups to prepare and then present your answer to your chosen question, before receiving feedback on your work.
