I found an interesting case that happened in California. Dr. Scott Green appeared in a Superior Court trial that was virtual due to covid from his operating room. The Dr. Was dressed in Surgical scrubs with a patient undergoing a procedure. The Court could hear the medical devices and machinery beeping in the background. The Courtroom clerk asked the Dr. if he was available for trial and the Dr. said yes. The Dr. acknowledged he was performing an operation and said another surgeon was present and could help perform the surgery. The Dr. kept working with his head down while waiting for the court commissioner to enter the chambers. The judge deemed this inappropriate and canceled the court hearing and set a new date for trial. The medical board is currently looking into this incident. The medical board was quoted saying “we expect physicians to follow the standard of care when treating their patients”. 
I do believe the standard of care was violated. As caregivers there is a certain code of ethics that all providers should adhere too. The Dr. not only put the patient at extreme risk while performing surgery and the patient deserves the full attention of the Dr. Even the simplest surgery’s can be dangerous and lead to death. To have a Dr. so careless is a scary thing. A patient who is unconscious due to anthesis put there full trust in the surgeon and to have this trust violated is breaking not only the physicians code of ethics but the standard of care that all providers should abide by. The standard of care definition varies from states to state but means the degree of care and skill of the average health care provider who practices in the providers specialty and takes in to account the medical knowledge that is available in the field. Most professionals in the field do not perform surgeries while video conferencing other people. This would not be reasonable which is how professional measure or judge practices of other professionals.
