Juvenile Offender Paper
Xander L., a 17-year-old male, has been taken to custody for unlawful access and use of a concealed armament. Based on the first information gathered from the arrest, Officer Borland is responsible for handling the case. Due to records and the rehabilitation history from the juvenile justice system records, Xander will be remanded at an adult prison until his mother is notified. In case the officer does not reach the parent, the case will begin. After the review of the case, the juvenile probation officers will review the matter further. The intake officer, in this case, Pagano, will informally handle Xander’s case to evaluate the prior records of pulse snatching, among others. With the collection of adequate information about the case, a decision will be made to hear the case.

All at this time, Xander is at the detention awaiting trial and is set to appear before Judge Honorable Cintron. This is done after he is handed over the critical investigation report by officer Pagano. The Judge would then review the case before the trial begins. With the review, he decided that Xander should continue being detained due to his previous records. Xander had already served a year in custody in a juvenile facility and has served in a probation twice. With this information, Judge Cintron has opted the juvenile to stay in detention until trial begins. He postulates that the delinquent is a threat to himself as well as the other members of the public. This shows that the juvenile’s mother will not be given his son until the case is heard and determined. When the hearing resumes, the prosecution will outline the crimes committed by the offender. This incorporate the previous charges as well as the current illegal possession of a weapon. Attorney Burt Benjamin, who is the prosecutor, informs the Judge that Xander had previously served time at the detention facility and a period of probation for crimes committed before. Since the weapon is not concealed as either dangerous or not and the absence of Xander’s mother, Benjamin- the prosecutor asks for a delinquency petition from Judge Cintron to hear the case in a formal hearing.
In case this is accepted, a series of assessments will be conducted to evaluate whether Xander is mentally capable of facing trial. After this assessment and Xander is proven fit, the case will proceed where Juvenile psychologists represent Xander and advocate for his trial in other juvenile systems rather than the adult court. Cintron critically listens to these arguments and notes the most important points presented by the teachers, mother, and close friends to Xander. Also, he notes the previous charges as read by Benjamin. After listening to the confessions and recommendations from the prosecutor, the Judge has a lot of factors to consider. He has an option to order a final rehabilitation since the prior crimes are non-violent. However, Judge opts to make Xander a ward of the state since his mother cannot keep him out of the streets and force him to change his behaviors.
Accordingly, “Status offenses are distinguished from delinquent acts by the fact that they are only law violations based on the offender’s “status” as a minor (Impact Law (2020).” Also, Cintron is aware of the age factor of Xander that is not far from attaining the legal adult age in a year. In this regard, the Judge decides the case as follows. Xander should be rehabilitated in Living Services, where he will be supervised and trained on various living skills. Additionally, he is to receive support services to enhance the skills that would enable him to secure a job or further in education (State of Hawaii Department of Human Services, n.d). The home will monitor and guide him.
Additionally, the Lining Home will subject him to a probation officer as well as to conduct drug testing. Xander is also to be monitored via an electric electronic device that he should wear on his ankle. He is further instructed to observe curfews placed and not to visit restricted locations. Judge Cintron’s ruling is tough for Xander. However, the Judge is considerate of his crimes and has offered a chance for self-redemption. Xander’s mother is warned that if her son does not change or observe the restrictions given, he would be forwarded to an adult court for criminal charges. Thus, he must follow the demands of the ruling and abide by the regulations of the Living Services.
