You are a sergeant for a small-town police agency in western Texas. The Chief hires a rookie officer (his nephew), and tells you to go ahead and put him on patrol, even though he does not have TCLEOSE training or certification. Following orders, you do so, and he goes on patrol on the mid-shift. He stops a car for a possible DUI about 1am, and the situation gets out of hand, and the rookie shoots the drunken driver. What would be the logical next step, legally, for the family of the driver? What might you expect, in terms of a civil liability lawsuit, as the rookie officer’s direct supervisor?
